Event Cancellation & Postponement Policy

Event Cancellation Policy

At Boo Productions, every event is carefully planned, scheduled, and resourced well in advance. As significant time, administration, venue commitments, supplier bookings, and other costs are incurred from the time of booking, the following cancellation policy applies to all confirmed event bookings.

By confirming an event booking, the Client acknowledges and agrees to the terms outlined below.

1. Notice of Cancellation

All requests to cancel an event must be submitted in writing by the Client via email or other agreed written communication. A cancellation will only be considered effective once written confirmation has been received by Boo Productions.

2. Refund Schedule

Refunds will be calculated based on the amount of notice provided before the scheduled event date.

More than 90 days before the event: The Client is entitled to a refund of 50% of all monies paid, less any non-recoverable costs or expenses already incurred on behalf of the Client.
Less than 60 days before the event: No refund will be provided due to the substantial commitments, supplier obligations, staffing costs, and preparations undertaken by this stage.
Any deposits paid remain subject to this policy and may be retained to cover administration and planning costs where applicable.

3. Postponement Instead of Cancellation

Where circumstances prevent the event from proceeding, Boo Productions will, where reasonably possible, work with the Client to postpone the event to a mutually agreed future date rather than cancel it.

Any payments already made may be transferred to the rescheduled event, subject to:

Availability of venues, suppliers, and event personnel.
Payment by the Client of any additional costs arising from the postponement.
Deduction of any expenses already incurred that cannot be recovered, including but not limited to venue deposits, supplier cancellation fees, permits, equipment hire, travel expenses, administration costs, marketing expenses, and planning fees.
Postponement is offered at the sole discretion of Boo Productions and is intended to minimise financial loss for both parties.

4. Force Majeure

Requests for cancellation or postponement under this policy must arise from genuine circumstances beyond the reasonable control of the Client and/or Boo Productions, commonly referred to as a Force Majeure Event.

Force Majeure Events may include, but are not limited to:

Natural disasters
Flood, fire, or severe weather
Pandemic or epidemic restrictions
Government orders or legal restrictions
Acts of terrorism
Civil unrest
War
Industrial disputes preventing the event from proceeding
Other unforeseeable events that make it impossible or unsafe to hold the event
Where a Force Majeure Event occurs, Boo Productions will make every reasonable effort to reschedule the event before considering cancellation.

5. Exclusions

This policy does not apply where the Client simply decides they no longer wish to proceed with the event or changes their mind.

Examples that do not qualify for a refund or special consideration include:

A change of personal preference.
A decision to postpone for convenience.
Budget changes.
Booking another provider.
Low attendance or ticket sales (unless otherwise agreed in writing).
Any other circumstance that does not constitute a genuine Force Majeure Event.
6. Expenses Already Incurred

Regardless of the timing of cancellation or postponement, Boo Productions reserves the right to deduct any reasonable expenses already incurred in relation to the event before calculating any refund.

These expenses may include, without limitation:

Venue deposits
Supplier payments
Equipment hire
Event Design Fees
Prop Builds
Site Visits
Staffing and contractor costs
Design and planning services
Permits and licences
Catering commitments
Travel and accommodation
Administrative costs

7. Company Cancellation

If Boo Productions is required to cancel the event due to circumstances within its reasonable control and no suitable alternative date can be agreed, the Client will receive a refund of monies paid, less any agreed non-recoverable third-party costs already incurred on the Client’s behalf.

8. Acceptance of Policy

By confirming an event booking and paying any deposit or invoice, the Client confirms that they have read, understood, and accepted this Cancellation & Postponement Policy in full.

This policy forms part of the event booking agreement between the Client and Boo Productions.
